Welcome to LABO-NOIR. LABO-NOIR and its affiliates provide access to the LABO-NOIR.com website (the “Website”) and sell our products to you subject to the terms and conditions set out on this page. Please read these conditions carefully before using the LABO-NOIR website. By using the LABO-NOIR website, you indicate that you agree to these terms.

ACCOUNT

If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You must take all necessary steps to ensure that your password remains confidential and secure and inform us immediately if you have reason to believe that your password has become known to anyone else or is being, or is likely to be, used in an unauthorized manner. Please ensure that the information you provide to us is accurate and complete and notify us immediately of any changes to the information you provided during registration.

LABO-NOIR reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at its sole discretion. If we cancel an order, this will be free of charge to you.

ORDERS

All orders are subject to acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other customers.

LABO-NOIR offers products for sale that are in stock and available for dispatch from our distribution center. However, from time to time, we may await shipments from our suppliers. As a result, you may occasionally be given the option to make an advance payment for certain items, allowing you to pre-order a product. This ensures that you receive the item with priority once the designer’s stock has been delivered to LABO-NOIR. LABO-NOIR only accepts pre-orders for stock scheduled for delivery by a designer. Your rights regarding pre-orders are the same as for any other purchase from LABO-NOIR. Alternatively, you may choose to register your email address to receive notifications when selected out-of-stock products become available again.

Items received in stock may be allocated in advance to fulfill pre-orders, and customers who have made advance payments will receive items with priority over waitlist customers or customers ordering through the website for immediate delivery. Please note that we may not be able to supply certain pre-ordered products due to production or quality control issues identified once stock is received. In such cases, we will notify you by email and refund the prepaid amount to your credit/debit card within thirty days after informing you that the product is unavailable.

If you have registered your email address for notification regarding the arrival of a specific product on our Website, we will attempt to notify you by email within 48 hours after the product becomes available online. Please note that in some cases, highly sought-after products may sell out during this period.

LABO-NOIR keeps a record of your transactions for at least one year.

LABO-NOIR does not sell products for purchase by children. If you are under 18 years old, you may only use LABO-NOIR with the involvement of a parent or guardian.

PRICING & PAYMENT

We provide information about the availability of products sold on the Website, including on each product information page. Other than what we state on those pages or elsewhere on the Website, we cannot provide more specific information regarding availability. Please note that shipping time estimates are only estimates. They are not guaranteed shipping times and should not be relied upon as such. While processing your order, we will notify you by email if any products you ordered become unavailable.

Prices are subject to change, and LABO-NOIR reserves the right to make changes at any time at its sole discretion. Please check the final sales price before submitting the relevant order form. Prices shown on the Website include VAT at the applicable rate.

Goods remain the property of LABO-NOIR until payment has been received and approved.

DELIVERY

You become the owner of the goods from the later of the following times: (a) when we receive full payment, or (b) when we deliver the goods to you.

LABO-NOIR insures every purchase during the time it is in transit until it is delivered to the delivery address you specify. We require a signature for all delivered goods, at which point responsibility for your purchased goods passes to you. If you designate a recipient other than yourself for delivery purposes (for example, as a gift), you accept that proof of a signature by them (or at that delivery address) is proof of delivery and fulfillment by LABO-NOIR, and responsibility transfers in the same way. The goods become your responsibility from the moment we deliver them to the address you provided.

Please note that we aim to dispatch all orders within 24 hours, or within 48 hours during sale periods. Delivery times displayed on the Website are estimates and intended as guidance only, starting from the date of dispatch. In any event, we will deliver the goods within 30 days from the date we accept your order. If delivery cannot be completed within 30 days, the customer has the right to cancel the sale. LABO-NOIR is not responsible for delays caused by customs clearance procedures.

If delivery is delayed due to circumstances beyond our control, we will contact you as soon as possible to inform you and will take steps to minimize the impact of the delay. Provided we do so, we will not be liable for delays caused by such events. However, if there is a risk of substantial delay, you may contact us to cancel your order, and we will refund any goods you have paid for but not received.

RETURNS

Returns will only be processed if items are returned in their original condition. Products must not have been opened or used, and packaging must remain sealed. If you have specific questions regarding returns, please contact our customer service. Further information regarding return processing can be found on our returns page.

PROMOTIONS

Promotional codes are non-transferable and cannot be exchanged for cash. Furthermore, they cannot be used in conjunction with any other promotional code or offer and must be redeemed before the published expiration date, if applicable.

All software used on this Website is the property of LABO-NOIR, its affiliates, or its software suppliers and is protected by Dutch, European, and international copyright laws.

You may not systematically extract and/or reuse parts of the Website content without the express written consent of LABO-NOIR. In particular, you may not use data mining, robots, or similar data gathering and extraction tools (whether once or many times) to reuse substantial parts of this Website without express written consent from LABO-NOIR. You may also not create and/or publish your own database featuring substantial parts of this Website (for example, prices and product listings) without express written permission from LABO-NOIR.
